LITTLE BIRDEE CATERING TERMS AND CONDITIONS

The following terms and conditions ("Catering Terms") apply to all catering orders for the supply of food and drink products by Little Birdee Catering ("Orders") submitted via www.littlebirdee.com.au ("Catering Service"). The Catering Service is operated by Little Birdee Espresso Pty Ltd ABN 22 161 597 753 ("Little Birdee," "we," "us," or "our").
By placing a catering order through www.littlebirdee.com.au, you agree to these Catering Terms. Payments made through the website are processed by Little Birdee Espresso Pty Ltd ABN 22 161 597 753. For further contact details, please visit www.littlebirdee.com.au/contact-us.
1. ACCESSING THE CATERING SERVICE
1.1 You may browse and place catering Orders by creating a user account ("Account") and registering on the website.
1.2 When creating an Account, you will be required to provide personal details and payment information, which will either be stored on your Account or with our secure third-party payment provider to make future Orders easier.
1.3 By creating an Account or submitting an Order, you warrant that all information provided is accurate and complete.
1.4 Orders placed via email or telephone will incur an administration fee of $30, plus a 10% surcharge on all products ordered, in addition to any other applicable charges.
2. PLACING CATERING ORDERS
2.1 To place a catering Order via the Catering Service, you will need to:
(a) Select the food and drink products you wish to order ("Ordered Products");
(b) Provide delivery or pick-up details (including delivery address or pick-up venue);
(c) Provide a delivery or pick-up time for your Order;
(d) Submit valid payment information; and
(e) Provide any other required details to finalise your Order.
2.2 Ensure that all details are accurate before submitting your Order, as we begin processing Orders immediately. Once an Order is submitted, it cannot be cancelled or modified, except as allowed under clause 6.
2.3 We reserve the right to refuse any Order at our discretion.
3. DELIVERY AND PICK-UP TIMES
3.1 When placing an Order, you must specify a delivery or pick-up time, which must fall within Little Birdee Catering's operating hours.
3.2 For delivery, we will ensure that the Ordered Products are delivered to the address provided at the time specified.
3.3 For pick-up, you must ensure that you collect your Ordered Products at the specified time and location.
3.4 Little Birdee Catering is not liable for delays caused by incorrect or incomplete delivery information provided by the customer.
4. PRICES
4.1 The prices listed on the Catering Service at the time of placing your Order will apply. All prices include GST.
4.2 The Catering Service may allow you to apply certain discounts or promotions to your catering Order. If a discount or promotion cannot be applied through the Catering Service, please contact us directly to place your Order.
4.3 We reserve the right to refuse any Order or adjust the price if an incorrect price is displayed due to a software malfunction or other interference with the Catering Service.
5. PAYMENT
5.1 Payment for the Ordered Products must be made at the time of submitting your catering Order using an approved payment method. Accepted payment methods include credit cards.
5.2 Payments will be processed immediately via our payment partner, Stripe, and debited from your account in accordance with your card provider's terms.
5.3 If we are unable to authorise your payment via the selected payment method, you will be notified, and your Order will not be processed.
5.4 We engage a secure third-party payment provider to process credit and debit card transactions. We do not store credit or debit card information on our servers, nor do we have direct access to your payment details.
6. CHANGES AND CANCELLATIONS
6.1 Changes and cancellations within 48 hours of the delivery or pick-up time will incur an administration fee of $30, plus a 25% surcharge on all products added or removed from the Order.
6.2 Changes and cancellations within 24 hours of the delivery or pick-up time will incur an administration fee of $60, plus a 50% surcharge on all products added or removed from the Order.
6.3 Orders placed via email or telephone will incur an administration fee of $30, plus a 10% surcharge on all products ordered, in addition to any other applicable charges.
6.4 Orders placed within 24 hours of the delivery or pick-up time will incur an administration fee of $60.
6.5 Orders placed within 48–24 hours of the delivery or pick-up time will incur an administration fee of $30.
6.6 Orders, changes, or cancellations made outside of these time frames can be processed without penalty.
6.7 Any refunds or additional charges due to changes or cancellations will be processed in accordance with the payment method used for the original Order.
7. THIRD-PARTY SERVICES
We may use third-party services for the delivery of catering orders. We are not responsible for any delays, damages, or failures caused by third-party service providers but will make every effort to ensure timely delivery.
8. LIABILITY AND DISCLAIMERS
8.1 While we strive to provide accurate information on our Catering Service, we cannot guarantee that all product descriptions, prices, and other content are complete or free from error. Little Birdee Catering reserves the right to make corrections to the Service and to cancel any Orders with incorrect information.
8.2 To the fullest extent permitted by law, including under the Competition and Consumer Act 2010 (Cth), we exclude all liability for any indirect, incidental, or consequential damages arising from the use of our Catering Service or the supply of any products.
8.3 If the Competition and Consumer Act 2010 (Cth) or analogous legislation applies and liability cannot be excluded, Little Birdee Catering’s liability is limited to, at our option:
(a) In the case of goods:
- Replacement of goods or equivalent goods;
- Repair of goods;
- Payment of the cost of replacing the goods or acquiring equivalent goods; or
- Payment of the cost of having the goods repaired.
(b) In the case of services:
- The supply of services again; or
- Payment of the cost of having the services supplied again.
9. MISCELLANEOUS
9.1 These Catering Terms are governed by Australian law, and any disputes arising from them are subject to the exclusive jurisdiction of the Australian courts.
9.2 These Terms, including any rights or licenses granted, may not be transferred by you but may be assigned by us without restriction.
9.3 Our failure to enforce any right or provision in these Catering Terms does not constitute a waiver of such rights.
9.4 If any provision of these Catering Terms is found to be invalid or unenforceable, the remaining provisions will continue to be in effect.

3. ONLINE ORDERING SERVICE
3.1 To place an order using the Online Ordering Service, you must create an account and accept the Online Ordering Terms, which are incorporated into these Terms by reference.
4. PROMOTIONS
4.1 From time to time, we may offer promotions or discounts via the Site. All promotions are subject to separate terms and conditions which will be made available at the time of the promotion.
5. ACCESS TO THE SITE
5.1 While we strive to keep the Site available 24 hours a day, we do not guarantee uninterrupted access, and we reserve the right to suspend or withdraw access without prior notice.
5.2 You are responsible for ensuring that anyone who accesses the Site through your internet connection is aware of and complies with these Terms.
6. SECURITY
6.1 The transmission of information over the internet is not completely secure. While we take reasonable steps to protect your information, we cannot guarantee the security of data transmitted to or from the Site.
6.2 Any transmission of data is at your own risk.
7. THIRD-PARTY LINKS
7.1 You may link to our Site, provided this is done in a legal and fair way that does not harm our reputation or suggest an endorsement or association where none exists.
7.2 We reserve the right to withdraw linking permission without notice.
